Development Directive was engaged by Geon Property to provide expert Town Planning advice in relation to a 4.564ha parcel of land compulsorily acquired by the Department of Transport and Main Roads at Stockroute Road, Bakers Creek, for the delivery of the Mackay Ring Road.
We were instructed to prepare a report determining the highest and best use of the land, and identifying potential severance impacts and disturbance items, to assist in proceedings before the Land Court of Queensland relating to the client's compensation claim for the taking of the land.
The assessment, prepared in 2021, required careful consideration of a number of site complexities — including the land's changing zoning over a number of years, existing development approvals, and the fact it had been resumed over five years prior to the report being prepared. Development Directive undertook a thorough review of current and superseded local and state planning instruments, draft local planning schemes, and development approvals granted across a six-year period, to inform a robust and well-substantiated expert opinion.
